European Trademark (CTM)

The working languages are: English, French, German, Italian and Spanish.

Priority may be claimed in accordance with the Paris Convention.

The proprietor of an earlier mark registered in a Member State who applies for an identical CTM may claim "seniority" from this earlier mark and the rights in the CTM with regard to the Member State in which the earlier mark was registered are the same as would be the case if the earlier mark had continued to be registered in the Member State.

Use of a Mark is not required prior to filing an application for a CTM.

A CTM is valid for all Member States of the EU even where the mark is not being used provided that it is being used in at least one Member State. However, a CTM may be cancelled if it is not used anywhere in the EU within 5 years of Registration or in any other continuous period of 5 years.
